What is Remote Online Notarization (RON)?

RON is a process where notarizations are performed using audio-visual technology over the internet. It allows signers and notaries to complete notarizations without being in the same physical location.

Is RON legal in New York?

Yes, New York State enacted laws permitting RON, with specific requirements that notaries and signers must meet. Notaries must be registered with the state as an electronic notary, follow technical standards, and be physically located in the state of New York during the notarization. The signer can be anywhere.

Is Remote Ink Notarization (RIN) legal in New York?

RIN is not allowed by New York notaries currently.

Can RON be used for all documents?

Most documents can be notarized via RON, but some cannot and those include wills, powers of attorney, health care proxies, trusts and do not resuscitate orders. Under the State Technology Law, they cannot be electronically signed therefore they cannot be electronically notarized. Also, it’s important to check with the receiver of a document to make certain that they will accept an electronically notarized document.

Can RON be used for real estate documents?

Yes, with permission of the title company and lender. The notary will need to know who the title insurance underwriter is so they can ensure that they use a platform on the underwriter’s approved list. Also, for documents being recorded, the notary will need to prepare a Certificate of Authenticity to be attached to the recordable, print off the executed documents and physically ship them to the client.

Can any notary prepare the Certificate of Authenticity, or must it be the notary who notarized the documents?

It must be the notary who notarized the documents.

What technology is required for RON?

For the notary – a NYS compliant platform must be used.

For the signer – they need a device with a webcam such as a computer, tablet or smartphone and a strong internet connection.

What are the record-keeping requirements for RON in New York?

Notaries must:

· Maintain a journal of RON acts, including details of the signer, documents notarized, and the date and time for ten years.

· Keep a secure, accessible recording of the RON session for the duration required by law (currently ten years in New York).

Does the signer need to be a United States citizen or have a credit history in the USA?

No, they do not.

What does the signer need for RON?

A valid government issued identification. It can be foreign identification.

Will the documents be wet signed?

No, the documents will be electronically signed and notarized. These are considered “originals” under the law. Other than documents to be recorded, the executed documents can be delivered by email without need for the Certificate of Authenticity or printing.

If the document will be filed with or relates to a matter involving a U.S. public official, court, government agency, or entity under U.S. jurisdiction or involves property in the U.S. or a transaction closely connected to the U.S.

Can RON be used if the if the signer is in the US and the document is to be used in Italy?

Yes.

Can RON be used if the signer is in Korea and the document is to be used for surrogate’s court in New York?

Yes.

Can RON be used if one signer is in Spain and one signer is in New York for a deed for a property in New York?

Yes, documents can be signed in counterpoint – your Spain signer by RON and your New York signer wet inked.

Can RON be used if the signer is in China and the document is to be used in Australia?

No.

If a document is executed by a signer outside of the USA is an apostille still needed?

No. Since the venue follows the notary, no trip to the consulate/embassy or apostille is needed.
