Professional Notary Services, Inc., a domestic business corporation incorporated under the laws of the State of New York, operates and manages the website professionalnotaryservices.biz (hereinafter referred to as the “Site”). The Site offers in-person and online notarization services, thereby constituting a mobile signing company operating primarily in the field of loan signing. Unless otherwise indicated, the Site may be accessed by users residing in any part of the world.
The present Privacy Policy (hereinafter referred to as the “Privacy Policy”) shall specify the terms upon which personal information and data submitted on or through the Site shall be collected, handled, stored, protected and disclosed by Professional Notary Services, Inc.
BACKGROUND
The Site offers a wide array of notarial services, including, without limitation, Mortgage and Loan Signings, Annuity and Debt Settlement signings, Auto Loans, Inspections, Collection Letter Delivery, Contract Paralegal Services and Attorney Assistance, Virtual Administrative Services, Campaign & Petition Signature Collection, Class Action Lawsuit Documents and other similar services (hereinafter collectively referred to as the “Services”). To facilitate the provision of Services, the Site shall help connect Users with qualified mobile notaries. Users may purchase Services on the Site, subject to the proper creation of a user account on the Site and the payment of the applicable fees for the Service(s) selected.
APPLICATION OF THE PRIVACY POLICY
The present Privacy Policy shall govern Professional Notary Services, Inc.’s collecting, handling, using, storing, protecting and maintaining of personal data and information obtained from or as a result of using of the Site. Any provision of personal data and information by a User on the Site shall be handled, stored, used and collected according to the terms of this Privacy Policy. Every User of the Site who submits or provides personal data and information on the Site shall benefit from certain rights, including, without limitation, the right to have any incorrect information corrected, and the right to delete information, as further detailed in this Privacy Policy.

Professional Notary Services, Inc. reserves the right to update this Privacy Policy at its discretion and at any time deemed appropriate by Professional Notary Services, Inc. As of its publication on the Site, the updated Privacy Policy shall be binding and applicable. PROVISION OF INFORMATION
Users do not need to provide personal data and information to access and use the Site. Nonetheless, while Users are not under any obligation to provide personal data and information on the Site, Users may not purchase Services or benefit from the Services if they do not provide personal data and information. As stated, a user account on the Site may be required for a User to proceed with the purchase of Services. In consideration of the above, Users acknowledge that they may be asked to submit personal data and information for purposes of creating a user account on the Site and to provide payment for Services. The creation of a user account on the Site shall allow a User to benefit from and purchase Services, subject to the payment of the applicable fees.
MINOR USERS
The Site is intended for Users who have reached the age of majority in their country of residence. The Site does not knowingly advertise to minors, nor target minor Users. If any User of the Site is below the age of eighteen (18), such minor User shall be encouraged to not use the Site, except with the minor User’s parent or lawful guardian’s knowledge and consent. In which cases, the minor User’s parent or lawful guardian shall supervise the minor User’s usage of the Site, thereby ensuring that the minor User does not proceed with any unintended purchases. Moreover, please be advised that minor Users should not submit any personal data and information on the Site.
TYPES OF PERSONAL DATA AND INFORMATION
According to applicable privacy laws, personal data and information refer to any information that successfully allows for the direct identification of an individual person. Personal data and information may therefore include an individual’s name, social security number and other identifying information, without limitation. Indirect identifiers refer to information that allows for the indirect identification of an individual person. Indirect identifiers shall include, without limitation, a User’s location and IP address. Indirect identifiers may be used in combination with other indirect identifiers and/or personal data and information to identify a specific person. On its own, an indirect identifier shall not allow for the identification of an individual person.
INFORMATION AND DATA COLLECTION
Professional Notary Services, Inc. is committed to protecting the privacy and confidentiality of its Users’ data and information. Professional Notary Services, Inc. acknowledges the importance of protecting all personal data and information received from the Site. Consequently, Professional Notary Services, Inc. shall only collect information that is voluntarily provided by Users on the Site.
Considering Users may purchase Services on the Site, Users shall be asked to input their relevant payment information, such as bank account number, PayPal account information or other payment method. Professional Notary Services, Inc. shall not gain access to Users’ bank account numbers and other private information. Professional Notary Services, Inc. shall only collect the purchasing User’s name and email. All payment information shall be applied by the payment processing company solely to process the User’s order on the Site. As stated, all payment information submitted by Users to place an order for Services shall not be collected nor stored by Professional Notary Services, Inc. As a result of accessing and visiting the Site, Professional Notary Services, Inc. may gain access to indirect identifiers relating to Users. Such indirect anonymous identifiers may include IP addresses and geographic location. Indirect identifiers may be used by Professional Notary Services, Inc. for analytical purposes. Lastly, as Users may proceed with purchases on the Site, Professional Notary Services, Inc. may receive information regarding Users’ purchase history on the Site.
USER ACCOUNTS
To proceed with the purchase of Services, Users may create a user account on the Site using plugins such as a calendar and scheduling platform. In furtherance of the creation of a user account on the Site, Users may submit personal information and data. Such personal data and information may consist of the User’s name, residential address, phone number and email address. The provision of such personal information and data shall be optional. Every User shall be responsible for ensuring the personal data and information provided as part of its user account is complete, accurate, up to date and true to the best of the User’s knowledge. The User agrees to update the personal data and information in its user account as soon as the information becomes expired or no longer accurate.
INFORMATION HANDLING
Professional Notary Services, Inc. shall employ reasonable commercial efforts to safeguard and protect the confidentiality of the personal data and information obtained from the Site. In this respect, Professional Notary Services, Inc. has implemented safeguarding measures to protect Users’ personal data and information from unauthorized access or leaks.
All personal data and information submitted by Users on the Site shall not be shared, disclosed, transmitted or otherwise given to any employees, contractors, consultants and affiliates, except for those who have a legitimate “need to know” such information to perform the Services. Professional Notary Services, Inc. agrees to use Users’ personal data and information solely for the purposes expressed in this Privacy Policy and for Professional Notary Services, Inc.’s legitimate business interests. As such, Users acknowledge that their personal data and information may be used by Professional Notary Services, Inc. in connection with the provision of Services, namely to perform the Services purchased, to process orders for Services and for Users to benefit from the Services. Users’ personal data and information provided on the Site may also be used for payment processing purposes and to fulfill Service orders placed by Users on the Site.

Legal obligations imposed upon Professional Notary Services, Inc. may emanate from applicable laws and regulations or from a valid court order. Professional Notary Services, Inc. shall have no choice but to comply with all applicable legal obligations and may therefore be required to disclose personal data and information. In case of a disclosure by Professional Notary Services, Inc. for legal purposes, Professional Notary Services, Inc. shall disclose the minimal data and information required to fulfill the legal obligation. If possible, Professional Notary Services, Inc. shall notify the affected User of the intended disclosure of its personal data and information to allow the User to seek a protective order.
Further, as per applicable laws, Professional Notary Services, Inc. may use personal data and information in furtherance of public interest or in connection with the public domain.
Professional Notary Services, Inc. shall be permitted to use personal data and information to respond to a User’s request or inquiry, in accordance with the authorization granted by the User. Professional Notary Services, Inc. may also use personal data and information to offer assistance to Users in connection to the Site.
Users shall have the option of granting Professional Notary Services, Inc. an explicit authorization to use their personal data and information for a specific purpose which exceeds the scope stipulated in this Privacy Policy. In such cases, the authorization granted by the User shall be provided in writing. Professional Notary Services, Inc. shall then use the authorizing User’s personal data and information pursuant and according to the authorization thereby provided and for the duration specified in the authorization. If no duration is specified, Professional Notary Services, Inc. shall use the User’s personal data and information for a reasonable duration, as determined based upon the nature of the authorization and its extent.
Professional Notary Services, Inc. may use personal data and information to send promotional emails to Users. Users shall then have the option of subscribing or unsubscribing to Professional Notary Services, Inc.’s promotional emails. To unsubscribe, Users shall select the appropriate option contained in the latest promotional email sent by or on behalf of Professional Notary Services, Inc. Upon Professional Notary Services, Inc.’s receipt of the User’s request to unsubscribe to promotional emails, Professional Notary Services, Inc. shall remove the requesting User from its mailing list. In addition, Professional Notary Services, Inc. reserves the right to use Google Analytics, thereby gaining access to indirect identifiers, such as location. Unless otherwise indicated, all data and information obtained from Google Analytics in connection with the Site shall be anonymous and shall not allow for the identification of a specific User. In all cases, Professional Notary Services, Inc. shall limit its usage of Users’ personal data and information, thereby using only such information as is strictly required to fulfill the purpose. Consequently, Professional Notary Services, Inc. agrees to restrict its usage of such information, within reasonable parameters as dictated by the purpose of the usage.
USER RIGHTS GRANTED
Users who submit personal data and information on the Site shall be granted rights in connection with such data and information. These rights may be exercised by a User at any time by following the processes detailed in this Privacy Policy.
Firstly, Users shall have the right to request information regarding the collection and usage of their personal data and information by Professional Notary Services, Inc. The User’s written request to receive such information from Professional Notary Services, Inc. shall be submitted by email. Upon receiving a written request by a User, Professional Notary Services, Inc. shall inform the requesting User of the collection and usage, if applicable, of the personal data and information. Professional Notary Services, Inc. shall only be responsible for sharing readily available information regarding its collection and usage of the User’s personal data and information. Professional Notary Services, Inc. shall not be responsible for sharing information regarding the processing of such personal data and information.
Professional Notary Services, Inc. shall not be responsible for verifying the veracity and accuracy of all personal data and information submitted by Users on the Site. Professional Notary Services, Inc. may however proceed with certain verifications, at its sole discretion, and without obligation. If a User determines that the personal data and information held by Professional Notary Services, Inc. is incorrect or otherwise misleading, such User may request the correction or deletion of the false information by sending an email to Professional Notary Services, Inc. Professional Notary Services, Inc. shall then proceed with the correction or deletion, as applicable, of the incorrect data and information.
Users may elect to delete any or all of their personal data and information from the Site, and the user accounts on the Site. In order to proceed with the deletion of their personal data and information, Users agree to submit a written request by way of email to Professional Notary Services, Inc. The written request shall specify the information and data that the User wishes to have deleted as well as the justification to support the request. A User may also request for its user account to be removed from the Site. Within a reasonable delay following its receipt of a request for deletion, Professional Notary Services, Inc. shall delete the personal data and information from its servers.
In the event that a User provided an explicit authorization pursuant to Section 11 of this Privacy Policy, the User shall benefit from the right to revoke or modify such authorization. The User may modify the authorization granted to Professional Notary Services, Inc. by sending an email indicating the modifications requested. The User may also revoke its authorization at any time by sending Professional Notary Services, Inc. an email with respect to the same. In accordance with the terms of this Privacy Policy, Professional Notary Services, Inc. shall perform the requested modifications, provided they are reasonable and legitimate, to the User’s authorization, or remove such authorization, as requested, following Professional Notary Services, Inc.’s receipt of the User’s requesting email.
INFORMATION STORAGE
All personal data and information collected from the Site shall be stored by Professional Notary Services, Inc. for the duration required by the applicable laws of the State of New York. Users’ personal data and information shall be securely stored in servers hosted and controlled by a third party engaged by Professional Notary Services, Inc.

We shall be permitted to assign, transfer, or subcontract our rights and obligations under these terms without your consent or any notice to you. You shall not be permitted to assign, transfer, or subcontract any of your rights and obligations under this agreement.
Force Majeure
Professional Notary Services is not liable for any delays caused by circumstances beyond Professional Notary Services’s control, e.g. general labor dispute, extreme weather, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above.
Entire Agreement
These Terms and Conditions set forth the entire understanding and agreement between you and Professional Notary Services concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written concerning the Site. A printed version of these Terms and Conditions and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved. You may not assign the Terms and Conditions, or assign, transfer or sublicense your rights therein. A failure to act concerning a breach by you or others does not waive Professional Notary Services’s right to act concerning subsequent or similar breaches.
Term and Termination
This agreement becomes effective the date that you first access the Site and remains effective until it is terminated consistent with its terms. Violations of this agreement may result in the immediate termination of this agreement and denials or terminations of your access to the Site. Such restrictions may be temporary or permanent. Upon termination, your right to use this Site shall be revoked. All disclaimers, limitations of liability, indemnities, and rights of ownership and licenses to Professional Notary Services shall survive any termination.
