Professional Notary Services, Inc., a domestic business corporation incorporated under the laws of the State of New York, operates and manages the website professionalnotaryservices.biz (hereinafter referred to as the “Site”). The Site offers in-person and online notarization services, thereby constituting a mobile signing company operating primarily in the field of loan signing. Unless otherwise indicated, the Site may be accessed by users residing in any part of the world.
The present Privacy Policy (hereinafter referred to as the “Privacy Policy”) shall specify the terms upon which personal information and data submitted on or through the Site shall be collected, handled, stored, protected and disclosed by Professional Notary Services, Inc.
BACKGROUND
The Site offers a wide array of notarial services, including, without limitation, Mortgage and Loan Signings, Annuity and Debt Settlement signings, Auto Loans, Inspections, Collection Letter Delivery, Contract Paralegal Services and Attorney Assistance, Virtual Administrative Services, Campaign & Petition Signature Collection, Class Action Lawsuit Documents and other similar services (hereinafter collectively referred to as the “Services”). To facilitate the provision of Services, the Site shall help connect Users with qualified mobile notaries. Users may purchase Services on the Site, subject to the proper creation of a user account on the Site and the payment of the applicable fees for the Service(s) selected.
APPLICATION OF THE PRIVACY POLICY
The present Privacy Policy shall govern Professional Notary Services, Inc.’s collecting, handling, using, storing, protecting and maintaining of personal data and information obtained from or as a result of using of the Site. Lastly, as Users may proceed with purchases on the Site, Professional Notary Services, Inc. may receive information regarding Users’ purchase history on the Site.
USER ACCOUNTS
To proceed with the purchase of Services, Users may create a user account on the Site using plugins such as a calendar and scheduling platform. In furtherance of the creation of a user account on the Site, Users may submit personal information and data. Such personal data and information may consist of the User’s name, residential address, phone number and email address. The provision of such personal information and data shall be optional. Every User shall be responsible for ensuring the personal data and information provided as part of its user account is complete, accurate, up to date and true to the best of the User’s knowledge. Professional Notary Services, Inc. may also use personal data and information to offer assistance to Users in connection to the Site.
Users shall have the option of granting Professional Notary Services, Inc. an explicit authorization to use their personal data and information for a specific purpose which exceeds the scope stipulated in this Privacy Policy. In such cases, the authorization granted by the User shall be provided in writing. To unsubscribe, Users shall select the appropriate option contained in the latest promotional email sent by or on behalf of Professional Notary Services, Inc. Upon Professional Notary Services, Inc.’s receipt of the User’s request to unsubscribe to promotional emails, Professional Notary Services, Inc. shall remove the requesting User from its mailing list. In addition, Professional Notary Services, Inc. reserves the right to use Google Analytics, thereby gaining access to indirect identifiers, such as location. Unless otherwise indicated, all data and information obtained from Google Analytics in connection with the Site shall be anonymous and shall not allow for the identification of a specific User. In all cases, Professional Notary Services, Inc. shall limit its usage of Users’ personal data and information, thereby using only such information as is strictly required to fulfill the purpose. Consequently, Professional Notary Services, Inc. agrees to restrict its usage of such information, within reasonable parameters as dictated by the purpose of the usage.
USER RIGHTS GRANTED

Professional Notary Services, Inc. shall then proceed with the correction or deletion, as applicable, of the incorrect data and information.

In order to proceed with the deletion of their personal data and information, Users agree to submit a written request by way of email to Professional Notary Services, Inc. The written request shall specify the information and data that the User wishes to have deleted as well as the justification to support the request. We shall be permitted to assign, transfer, or subcontract our rights and obligations under these terms without your consent or any notice to you. You shall not be permitted to assign, transfer, or subcontract any of your rights and obligations under this agreement.
Force Majeure
Professional Notary Services is not liable for any delays caused by circumstances beyond Professional Notary Services’s control, e.g. general labor dispute, extreme weather, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above.
Entire Agreement
These Terms and Conditions set forth the entire understanding and agreement between you and Professional Notary Services concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written concerning the Site. A printed version of these Terms and Conditions and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved. You may not assign the Terms and Conditions, or assign, transfer or sublicense your rights therein. A failure to act concerning a breach by you or others does not waive Professional Notary Services’s right to act concerning subsequent or similar breaches.
Term and Termination
This agreement becomes effective the date that you first access the Site and remains effective until it is terminated consistent with its terms. Violations of this agreement may result in the immediate termination of this agreement and denials or terminations of your access to the Site. Such restrictions may be temporary or permanent. Upon termination, your right to use this Site shall be revoked. All disclaimers, limitations of liability, indemnities, and rights of ownership and licenses to Professional Notary Services shall survive any termination.
